1. Scope of Application

These General Terms and Conditions (GTC) apply to all business relations between Tera Analytics, represented by Leon Metzger, Paradiesstraße 126A, 70563 Stuttgart, Germany (hereinafter referred to as „Tera Analytics“), and its customers. By placing an order or registering with Exclusive Markets, customers accept these GTC.

2. Products and Services

Tera Analytics provides the following digital products and services:

• Expert Advisors (EA)
• Indicators
• 1-on-1 sessions for trading advice
• Trading signals via a Telegram group
• Custom programming of EAs based on customer requests

All products are digital, and no physical goods are delivered.

3. Contract Conclusion

The contract between Tera Analytics and the customer is concluded either:

1. By purchasing a product on the website and receiving an email with the products and corresponding materials.
2. By registering with the partner broker, Exclusive Markets, where customers receive the products free of charge depending on their deposit amount.

The contract is concluded once the customer receives an order confirmation via email. No specific age restrictions apply, but products should not be used by individuals who are unaware of the risks involved in trading.

4. Prices and Payment Terms

• Products purchased directly through the website are paid for at the time of purchase. The products provided through registration at Exclusive Markets are free of charge, depending on the deposit amount.
• Payments are processed via Woopayment, which offers various common payment methods (e.g., credit card, PayPal).
• There are no additional shipping or handling costs.

5. Delivery of Products

• Products are delivered digitally via email. Customers will receive either the files (in the case of Expert Advisors or Indicators) or a link to access the trading signal group.
• Access to the Telegram trading signal group is provided via an invitation link, and Expert Advisors are sent as downloadable files.

6. Right of Withdrawal

As the products are digital and access is granted immediately after purchase, no right of withdrawal applies. Once access to the products has been provided, returns or refunds are not possible.

7. Liability and Disclaimer

The use of Tera Analytics’ products is at the customer’s own risk. Tera Analytics does not accept liability for any losses incurred as a result of using its products. Trading financial instruments, including using automated trading systems such as Expert Advisors, carries significant risk and can lead to the loss of all invested capital.

By using Tera Analytics‘ products, the customer acknowledges and agrees that:

• Tera Analytics is not a licensed financial advisor, and no guarantees are made regarding profitability or success.
• The customer is solely responsible for all trades and decisions made using Tera Analytics‘ products. Tera Analytics disclaims any liability for direct, indirect, incidental, or consequential losses, including financial losses or technical failures.
• No responsibility is accepted for any software errors or market conditions affecting product performance.

The customer should only trade with funds they are willing to lose, as automated trading systems can be unpredictable, and market conditions may impact the performance of the products.

8. Copyright and Usage Rights

All products, including Expert Advisors, Indicators, and other digital content provided by Tera Analytics, are protected by copyright. Customers are granted a non-exclusive, non-transferable right to use the products for personal purposes. The products may not be shared, sold, or distributed to third parties.

9. Data Privacy

Tera Analytics collects only the customer’s email address for the purpose of delivering products. In the case of registration through Exclusive Markets, the necessary data is collected by the broker, and customers must refer to the broker’s privacy policy for further details.

Payments are processed through Woopayment, which handles all required data during checkout. Tera Analytics has no influence over the data collected by Woopayment and is not responsible for its handling.

10. Subscription and Termination

• Customers who subscribe to the Telegram trading signal group are charged a monthly fee of €30. The subscription can be canceled at any time with one month’s notice.
• Other products are either sold via one-time payments or provided for free through registration with Exclusive Markets.

11. Use of Exclusive Markets and Account Monitoring

Customers who receive free products via registration with Exclusive Markets are expected to use these products exclusively with Exclusive Markets. Tera Analytics reserves the right to monitor usage and, if it becomes apparent that a customer is using the products on another broker’s platform, remove them from the Telegram group or revoke access to other services.

Expert Advisors and other tools provided by Tera Analytics are designed to work solely on MT platforms offered by Exclusive Markets. Using them on other platforms or brokers is prohibited.

12. Applicable Law and Jurisdiction

The laws of the Federal Republic of Germany apply to all contractual relations between Tera Analytics and its customers. The place of jurisdiction for any disputes is Stuttgart, Germany.

13. Severability Clause

Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision that comes closest to the intended purpose shall apply.

The use of the Expert Advisors, Signals or other Products provided by Tera Analytics is at your own risk. We do not accept any liability for losses that may occur through the use of our products. Trading in financial instruments, including the use of automated trading systems, involves significant risk and can result in the loss of all your invested capital. Past performance is not indicative of future results. Each user is fully responsible for their trading decisions and should be aware of the risks involved before using our products.

By using any Product offered by Tera Analytics, you acknowledge and agree that:

• You are solely responsible for any trades executed using our products, and we make no guarantees regarding profitability or success.
• Tera Analytics assumes no responsibility for any direct, indirect, incidental, or consequential losses or damages arising from the use of all our products, including but not limited to, financial losses, trading failures, or errors in the software.
• You should only trade with money that you can afford to lose, as automated trading systems can be unpredictable, and market conditions may affect the performance of the Expert Advisors, Indicators or other Products.

We do not guarantee the accuracy, functionality, or reliability of our software. Tera Analytics disclaims any warranties, express or implied, regarding the fitness for a particular purpose, merchantability, or the uninterrupted and error-free operation of our Products. Technical issues, software bugs, or external factors such as market conditions, broker malfunctions, or internet outages may affect the performance of our products, for which we do not accept any responsibility.

Tera Analytics does not hold authorization from the Federal Financial Supervisory Authority (BaFin) or similar regulatory bodies to provide financial services. Any liability claims that cannot be legally excluded are limited to the amount of the fees paid for the respective product. The user acknowledges that they take full responsibility for all trading decisions and cannot make any claims against Tera Analytics.
